    Indiana House Bill 1006 – Cosmetology Sector Warns of Health and Safety Implications for Indiana Consumers


    (January 16, 2012 – Indianapolis) Indiana HB 1006, under review by the House Committee on Employment, Labor and Provisions, presents significant health and safety concerns for Indiana consumers according to leadership in the beauty industry.

    Sponsored by Rep. David Wolkins, HB 1006 seeks to repeal laws governing various professions, including “beauty culture.” The term “beauty culture” includes hairstylists, barbers, estheticians and manicurists/pedicurists. If advanced through the legislature and signed into law, HB 1006 would eliminate the need for an individual to secure licensing prior to working as a cosmetologist or barber.

    Cosmetology and barbering professionals from around the state have expressed that the bill poses more than a competitive concern, but presents health and safety concerns for consumers, ranging from fungal infections to MRSA. According to John Halal, past president of the American Association of Cosmetology Schools and owner of Fishers-based Honors Beauty College, deregulating Indiana’s beauty profession would provide a license for unethical or simply uneducated individuals to market themselves as hairstylists, manicurists, estheticians and more.

    A published author and industry speaker on hair chemistry and structure, Halal cautions that beauty professionals use chemicals, tools and processes that demand highly specialized knowledge. “Recent concern about formaldehyde in Keratin treatments is just one example of the safety issues beauty professionals address every day. Similarly, tools such as razor blades, flat irons and nail files can cause burns, skin irritations or infection if improperly cared for and used,” Halal stated.

    He added that while cosmetology education is often perceived as learning how to cut hair or file nails, the curriculum (currently 1500 for a cosmetology license in Indiana) encompasses a much broader array of topics ranging from physiology/anatomy for massage therapists to chemistry for estheticians and colorists. Yet other portions of the curriculum address safety and sanitation. “The beauty industry remains one of a very few professions where physical contact occurs between provider and consumer. As such, there must be standards in place to ensure the safety and integrity for both parties,” he added.

    A public hearing on HB 1006 is scheduled for Friday, January 20.

    State Rep. David Wolkins says he plans to listen to the people the proposal affects the most."We are going to listen to the testimony and decide what to do then," Wolkins said. "I would guess there will be some changes in the cosmetology part of it."

  4. Very good start! While you are at it, deregulate TV repairmen, Jewelry repairmen and all the other worthless regulatory agencies the state has added to the burden and cost of conducting a business.
    In addition to a store license, we have to buy a license in our stores to sell fishing worms (bait dealer’s license). We have to buy a license to sell eggs. It goes on and on.....
    The only thing the egg inspector wants to see is if we paid our $25 for the license.

    :To all the members of the Indiana House of Representatives: You should pick up a book from one of the Cosmetology schools and glance through it! You will be greatly surprised what we have studied in order to get our license! And if you pass this down the road, I certainly hope a member of your family, or YOU, patronize someone who does not have a license, and you get your hair burnt off, or scalp burnt, or aides, or some infection!!! This has to be one of the most rediculious bills, in a long time!!!!!
